Lawsuit claims ambulance service administered nitrous oxide instead of oxygen

PRESTONSBURG A lawsuit filed in Floyd County Circuit Court claims that a local ambulance service is responsible for the death of a Floyd County woman.

The suit, filed May 13 by Denzil Yates Jr., claims that Tran-Star Ambulance Service caused the death of his wife, Josephine Yates, while transporting her from Our Lady of the Way Hospital to Central Baptist Hospital in Lexington.

The suit claims that during her transport on Aug. 20 , 2002, Tran-Star Ambulance failed to provide Josephine Yates with the proper amount of oxygen, which caused the ambulance to make an emergency stop at Morgan County Appalachian Regional Healthcare in West Liberty.

According to the suit, the staff at Morgan County Appalachian Regional Healthcare directed Tran-Star to provide oxygen to its patient but gave the ambulance crew nitrous oxide instead. The ambulance crew “negligently” administered the nitrous oxide to Yates during her transport from West Liberty to Lexington and, as a result, Yates died, the suit says.

Denzil Yates is represented by attorneys Paul Deaton and Dwight S. Marshall.

A lawsuit represents only the plaintiff’s cause for action.
