Notices of intent to promulgate administrative regulations

FRANKFORT — The following EMS-related notices of intent to promulgate administrative regulations were received as of noon, November 15 by the Kentucky Legislative Research Commission.

BOARD OF NURSING

November 8, 2002

(1) 201 KAR 20:056. Advanced registered nurse practitioner registration, program requirements, recognition of a national certifying organization.

(2) The Board of Nursing intends to promulgate the administrative regulation governing the subject matter listed above.

(3) A public hearing to receive oral and written comments on the proposed administrative regulation has been scheduled for December 23, 2002 at 9 a.m. (EST) in the Boardroom, Kentucky Board of Nursing, 312 Whittington Parkway, Suite 300, Louisville, Kentucky, 40222.

(4)(a) The public hearing will be held if:

1. It is requested in writing by at least 5 persons, or an administrative body, or an association having at least 5 members; and

2. A minimum of 5 persons, or the administrative body or association, agrees, in writing, to be present at the public hearing.

(b) If a request for a public hearing and agreement to attend the public hearing is not received at least 10 days prior to December 23, 2002, the public hearing will be cancelled.

(6)(a) KRS Chapter 13A provides that persons who desire to be informed of the intent of an administrative body to promulgate an administrative regulation governing a specific subject matter may file a request to be informed by the administrative body.

(b) Persons who wish to file this request may obtain a request form from the General Counsel, Kentucky Board of Nursing, 312 Whittington Parkway, Suite 300, Louisville, Kentucky 40222.

(7) Information relating to the proposed administrative regulation:

(a) The statutory authority for the promulgation of an administrative regulation relating to the regulation of nursing is KRS 314.131.

(b) The administrative regulation that the Board of Nursing intends to promulgate amends 201 KAR 20:056. Advanced registered nurse practitioner registration, program requirements, recognition of a national certifying organization, an existing administrative regulation.

(c) The necessity, function, and conformity of the proposed administrative regulation is as follows: The amendments pertain primarily to the incorporation of new application forms and to the requirements for recognition as a national certifying organization.

(d) The benefits expected from this administrative regulation are: The benefits are new application forms and a more precise way of recognizing national certifying organizations.

(e) The administrative regulation will be implemented as follows: Through normal agency procedures.

(1) 201 KAR 20:057. Scope and standards of practice of advanced registered nurse practitioners.

(2) The Board of Nursing intends to promulgate an administrative regulation governing the subject matter listed above.

(3) A public hearing to receive oral and written comments on the proposed administrative regulation has been scheduled for December 23, 2002 at 9 a.m. (EST) in the Boardroom, Kentucky Board of Nursing, 312 Whittington Parkway, Suite 300, Louisville, Kentucky, 40222.

(4)(a) The public hearing will be held if:

1. It is requested in writing by at least 5 persons, or an administrative body, or an association having at least 5 members; and

2. A minimum of 5 persons, or the administrative body or association, agree in writing to be present at the public hearing.

(d) The benefits expected from this administrative regulation are: The utilization of new scope and standard of practice statements.

(e) The administrative regulation will be implemented as follows: Through normal agency procedures.

(2) The Board of Nursing intends to promulgate an administrative regulation governing the subject matter listed above.

(3) A public hearing to receive oral and written comments on the proposed administrative regulation has been scheduled for December 23, 2002 at 9 a.m. (EST) in the Boardroom, Kentucky Board of Nursing, 312 Whittington Parkway, Suite 300, Louisville, Kentucky, 40222.

(e) The administrative regulation will be implemented as follows: Through normal agency procedures.

(2) The Board of Nursing intends to promulgate an administrative regulation governing the subject matter listed above.

(3) A public hearing to receive oral and written comments on the proposed administrative regulation has been scheduled for December 23, 2002 at 9 a.m. (EST) in the Boardroom, Kentucky Board of Nursing, 312 Whittington Parkway, Suite 300, Louisville, Kentucky, 40222.

(4)(a) The public hearing will be held if:

1. It is requested in writing by at least 5 persons, or an administrative body, or an association having at least 5 members; and

2. A minimum of 5 persons, or the administrative body or association, agree in writing to be present at the public hearing.

(c) The necessity, function, and conformity of the proposed administrative regulation is as follows: To allow Board of Nursing approved providers to offer HIV/AIDS continuing education.

(d) The benefits expected from this administrative regulation are: Expands the pool of available courses.

(e) The administrative regulation will be implemented as follows: Through normal agency procedures.

(1) 201 KAR 20:310. Faculty for prelicensure registered nurse and practical nurse programs.

(2) The Board of Nursing intends to promulgate an administrative regulation governing the subject matter listed above.

(3) A public hearing to receive oral and written comments on the proposed administrative regulation has been scheduled for December 23, 2002 at 9 a.m. (EST) in the Boardroom, Kentucky Board of Nursing, 312 Whittington Parkway, Suite 300, Louisville, Kentucky, 40222.

(4)(a) The public hearing will be held if:

1. It is requested in writing by at least 5 persons, or an administrative body, or an association having at least 5 members; and

2. A minimum of 5 persons, or the administrative body or association, agree in writing to be present at the public hearing.

(d) The benefits expected from this administrative regulation are: Will clarify the credentials needed to be a program of nursing faculty member.

(e) The administrative regulation will be implemented as follows: Through normal agency procedures.

(2) The Board of Nursing intends to promulgate an administrative regulation governing the subject matter listed above.

(3) A public hearing to receive oral and written comments on the proposed administrative regulation has been scheduled for December 23, 2002 at 9 a.m. (EST) in the Boardroom, Kentucky Board of Nursing, 312 Whittington Parkway, Suite 300, Louisville, Kentucky, 40222.

(4)(a) The public hearing will be held if:

1. It is requested in writing by at least 5 persons, or an administrative body, or an association having at least 5 members; and

2. A minimum of 5 persons, or the administrative body or association, agree in writing to be present at the public hearing.

(d) The benefits expected from this administrative regulation are: To improve the student's ability to begin practice as a nurse.

(e) The administrative regulation will be implemented as follows: Through normal agency procedures.

(2) The Board of Nursing intends to promulgate an administrative regulation governing the subject matter listed above.

(3) A public hearing to receive oral and written comments on the proposed administrative regulation has been scheduled for December 23, 2002 at 9 a.m. (EST) in the Boardroom, Kentucky Board of Nursing, 312 Whittington Parkway, Suite 300, Louisville, Kentucky, 40222.
