KBEMS has method to receive and review comments on proposed regulations By
BRIAN BISHOP House Bill 469 Regulations Plan During the 2002 meeting of the Kentucky General Assembly KBEMS, KAPA, KAEMT, and many other groups and individuals worked to pass House Bill 469. With the passage of the bill complete, there is a need to revisit the regulations that are currently governing EMS in Kentucky. The board, through formal action, has adopted the following process: 1. The office will write the initial PROPOSALS. 2. The regulations committee will approve or correct the initial PROPOSALS to send to the board. 3. The board will approve INITIAL PROPOSED DRAFT regulations to be posted for public comment. Once the INITIAL DRAFT regulations are posted. the office will receive comments from the public in a written format to pass to the regulations committee and then to the board. The process of receiving comments will continue until September when the board meets at the annual EMS conference in Owensboro, KY. During the September meeting the board will have the opportunity to review the comments that have been passed by the regulations committee and a final version of the regulations will be written. The board has scheduled a meeting in October to officially approve the final version of the ordinary regulations. Only then will the entire package enter the formal LRC regulations process and once again the public will have the opportunity to comment on these regulations as they make their way through the hearing process. The above process has been augmented for the fee regulation. The board voted to have the fee regulation sent to a task force comprised of the following agencies:
The president or CEO of each agency has been contacted to send a representative to a meeting to be held July 11, 2002 in Frankfort to discuss the fee regulation. The recommendations from that committee will be reported to the board at the August 8th meeting. Any regulations, including the fee regulations, posted on the KBEMS website is a PROPOSED DRAFT regulation and has not entered the official LRC process to become an ordinary regulation. It is the goal of the office, the board, and the providers to allow this regulations process to be a slow and steady one that will allow individuals and services to make any comments they feel necessary on any of the PROPOSED DRAFT regulations.
