The DHHS Office of the Inspector General has issued another
Advisory Opinion on an ambulance supply restocking agreement.
In this case, the hospital provides free supplies and medications
to volunteer EMS providers that do not bill. The hospital does not
bill any federal health program for the supplies either. This is
done with the encouragement of a Regional EMS Council.
In this specific instance, the OIG advises that they would not
consider this arrangement as a violation of the anti-kickback
statute because the intent is not to induce the ambulance
companies to bring patients to the hospital.
